There are federal and state laws which govern the payment of overtime wages.  There are significant differences between the two.  For example, in the  State of Illinois,  an employee can still collect overtime pay up to three years after the overtime violation.  Federal law provides that an employee can collect up to two years after and up to three years if it is found the employer knowingly and intentionally violated federal overtime laws.
